Under Illinois statute 750 ILCS 5/503, marital property means all property acquired by either spouse after the marriage except for certain types of non-marital property such as acquired through a gift, legacy or descent, and other exceptions set forth in the law. There is also a presumption that pension benefits acquired by either spouse after a marriage and before a judgment of dissolution of marriage are considered marital property.
